[口語]離婚協(xié)議書 divorce settlement
近日，順義法院對(duì)該院審理的800余件離婚案件進(jìn)行調(diào)研發(fā)現(xiàn)：離婚訴訟中超過50%的女性稱自己在婚姻中的權(quán)利受到了損害，突出表現(xiàn)為遭受丈夫的家庭暴力和丈夫有婚外情；女性對(duì)婚姻的幸福指數(shù)遠(yuǎn)遠(yuǎn)低于男性，因此有七成離婚訴訟是由女性提起的。

大多數(shù)夫妻會(huì)先行簽定離婚協(xié)議書。無法在財(cái)產(chǎn)分配或子女監(jiān)護(hù)等問題上達(dá)成一致時(shí)，他們才采取法律手段。
在上面的報(bào)道中，divorce settlement就是“離婚協(xié)議書”，也可以用marital termination agreement來表達(dá)，是指即將解除婚姻關(guān)系的夫妻雙方所簽署的、關(guān)于division of property（財(cái)產(chǎn)分割）、custody and visitation of children（子女監(jiān)護(hù)與探視）、spousal support（配偶贍養(yǎng)費(fèi)）以及child support（子女撫養(yǎng)費(fèi)）等的書面協(xié)議。
在順義區(qū)法院調(diào)查的離婚案件中，incompatibility（無法相處）、extramarital affairs（婚外情）和domestic violence（家庭暴力）是離婚的主因。
